FynFund operates as a business lending broker. We connect business owners seeking funding with third-party lending partners. We are not a direct lender. We do not make lending decisions, guarantee loan approvals, or set loan terms. Our role is to facilitate the application process and match your business with potential funding sources.

Key points about our Services:

• We submit your application to one or more lending partners on your behalf
• Lending decisions are made solely by the lending partners
• Loan terms, rates, and conditions are set by the lending partners
• You are under no obligation to accept any offer presented to you
• Our service to applicants is provided at no cost — we are compensated by lending partners

To use our Services, you must:

• Be at least 18 years of age
• Be a legal resident of the United States
• Be authorized to apply on behalf of the business entity listed in your application
• Have the legal capacity to enter into binding agreements

By submitting an application through our Site, you certify that:

• All information provided is true, accurate, and complete to the best of your knowledge
• You are authorized to apply on behalf of the business whose name appears on the application
• You will notify us of any material changes to the information provided
• You understand that providing false information may result in denial of your application and potential legal consequences

By submitting an application, you authorize FynFund, its agents, and its lending partners to:

• Contact third parties to verify the information you provide
• Request personal and business credit reports from credit reporting agencies
• Share your application information with lending partners for evaluation
• Conduct inquiries for the purpose of evaluating your application, or for any update, renewal, extension of credit, or other lawful purpose

Upon your request, we will advise you if a credit report was obtained and provide the name and address of the credit bureau.

By providing your phone number and email address, you agree that we may contact you about your inquiry, application and account by phone and email. Where you agree to it on our application, calls may be made using an automatic telephone dialing system or prerecorded voice. Consent to these calls and to marketing email is not a condition of obtaining our Services, and you can unsubscribe from marketing email at any time.

By providing your mobile phone number and checking the SMS consent box, you consent to receive SMS text messages (including automated messages) from Liberty Bell Capital LLC (FynFund) for customer care, account-related, and promotional/marketing purposes. Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP. For help, reply HELP or contact us at support@fynfund.com. Consent is not a condition of purchase.

Mobile carriers are not liable for delayed or undelivered messages.

FynFund does not guarantee that you will receive a loan offer or funding. Submitting an application does not constitute a commitment, agreement, or guarantee of any kind from FynFund or its lending partners. Approval and terms are subject to the lending partner's underwriting criteria, which may include credit history, business performance, time in business, and other factors.

All content on the Site — including text, graphics, logos, icons, images, and software — is the property of FynFund or its content suppliers and is protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

You agree not to:

• Use the Site for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to our systems or data
• Interfere with the proper functioning of the Site
• Use automated tools to scrape, crawl, or harvest data from the Site
• Impersonate any person or entity

To the fullest extent permitted by law, FynFund shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or Services, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.

FynFund's total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid to FynFund (if any) in the twelve months preceding the claim.

Our Site and Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

You agree to indemnify, defend, and hold harmless FynFund and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Florida.

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last Updated" date. Your continued use of the Site after any modifications constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
